USCIS has announced exciting updates for international students in the U.S. with F visas. F-1 visa students can now directly apply for immigrant visas under the Employment-Based (EB) category. They can benefit from permanent labor certification or immigrant visa petitions while still intending to leave after a temporary stay.

Clear guidelines have been provided for employment authorization, status changes, extensions, and reinstatements for F and M student nonimmigrant classifications.

Additionally, STEM graduates can use their 36 months of Optional Practical Training (OPT) to work at early-stage startups, provided the startup follows specific requirements such as training plans, good standing with E-Verify, and fair compensation comparable to U.S. workers in similar roles.”
